Update January 2012: Update on Mediations.

You may have seen from news media that the plan change for St Lukes has now been approved. This has come as result of ongoing mediation with Auckland Council and Westfield over the course of last year resulting in us reaching a settlement position at the end of December.

An enormous amount of time and effort from committee members has gone into meetings with council officers, Westfield executives, and the band of lawyers that accompany everyone. Our official position has always been to fight this all the way through the legal system. While the reality of our funding situation was always going to make that challenging, and has forced us to make compromises, our negotiation has overall achieved a better outcome for our community than the initial proposal.

We have made every effort to get what gains for the community we could from the mediation process- unfortunately the mediation from the mayor was ultimately unproductive and expensive and many aspects of this were decided well before we were informed about it.

It is fair to say we are very disappointed that we were unable to stop the road entrance into Aroha Avenue, and that we remain concerned about the impact of such a development in our area and the traffic modeling used, however in the end we simply don't have the resources to test this further in the Environment Court.

We have however been able to maintain a residential interface to the mall development and we have a commitment to a traffic management consultation and planning involving the community and covering a wider area than initially proposed.

We have managed as tightly as possible our expenditure on our lawyer Douglas Allen of Ellis Gould.

Your financial support to date has supplied our effort with oxygen and helped get this result. The committee realises our personal responsibility for the outstanding debt and we need to ask again that you donate to the SLCA fund. We really appreciate anything you can offer.

Here's that bank account again:

{UpDownScroller style:pscroller5 pause:12500} "The St Lukes Community Association and the people of Mt Albert want to preserve their community’s distinctive identity. I support them in opposing the private plan change that will exclude their voice and encourage Westfield to work with residents on development that allows the local community’s concerns to be met." David Shearer, Labour Party. --- "I can't believe that Westfield St Lukes wants to extend Exeter Road into Aroha Ave making our small quiet street a major route to the carpark. Putting an entrance way to the carpark on Aroha Ave will destroy our peaceful street and will be a major safety concern for the local children." J.T. --- "We think the impacts on the local community - with the loss of trees, increase in local traffic and the intrusive height of planned buildings on the Aroha Ave street frontage - are simply unacceptable. We urge Westfield to open real negotiations with the community to address the genuine concerns that local residents have." Dr. Russel Norman, Green Party Co-Leader. --- "It is clearly up to Westfield to convince the community that the changes they propose will work for the people who live nearby. So far it is obvious that they have not done this." Melissa Lee, MP, National Party. --- "I understand the Association’s concerns and I think they are very reasonable." John Boscawen, MP, ACT Party. --- "By applying for a private plan change Westfield have adopted an extremist approach. There are many approaches to the expansion including ones that need not adversely affect the local community. Why wouldn't Westfield want to be a good community citizen?" J.D. --- "I read that Westfield was looking to extend St Lukes but I had no idea they planned to build an entry through your lovely street – you can see the impact the entries on the residential properties on streets on the other side of the mall and it isn’t good – I’ve printed off the form and will send it back to you immediately. Hope you are successful getting this squashed." H.M. --- "You have our support. As residents and ratepayers there does come a time when we have to stand up and say – this is not a house, this is our home. What ever happened to the importance placed on enjoyment, peace and rest and relaxation and family life versus big business." L.B. {/UpDownScroller}
